Delaware over-the-counter tax liens

Delaware runs no statewide over-the-counter route: unsold inventory goes back to the next sale. Tax Sale Atlas holds this for all 3 Delaware counties, read from 9 Del. C. Chapter 87 and checked Sep 25, 2026.

Unsold liens and parcels do not disappear, but Delaware runs no standing over-the-counter program. Here is what happens to the inventory nobody bought, and where to watch instead.

Why Delaware has no over-the-counter list

Delaware has no over-the-counter sale of tax-sale property and no county-held certificate list. Chapter 87 provides none. What it provides instead is re-sale: if the county does not approve the final bid at a monition sale it may expose the property to as many further sales as it chooses (9 Del. C. 8726), and if the Superior Court sets a sale aside another sale may follow. In New Castle County, County Council may authorize an agent to bid in for the County at no more than the amounts owed to it, and title then goes to New Castle County (9 Del. C. 8753); any later disposal of that property is a County matter outside Chapter 87.

Does Delaware publish a lands-available list?

No statewide or county lands-available list was found. Ask the county finance office whether any county-owned parcels acquired at a sheriff sale are offered for sale.

Because there is no standing list, Delaware inventory reaches investors through the scheduled auctions instead. Check the county pages for each county's sale calendar, and compare against the states that do hold land off-auction before trusting any list marketed as an Delaware over-the-counter list.
