Tax deed sale

Run by
Oconee County Tax Commissioner (Jennifer T. Riddle), which levies on real property for unpaid ad valorem taxes
Frequency
annual
Typical timing
No sale calendar is published. The Tax Commissioner's designated "Tax Sale" page loads but its content area is an empty stub, so no date, time, or location is posted. The FAQ states only the levy authority: "If the property taxes remain unpaid, the Tax Commissioner has the right and responsibility to levy on the property for non-payment." The office's own Excess Funds listing records past sale dates of 4/2/2013, 5/5/2015 and 6/6/2017. Each of those is the first Tuesday of its month, consistent with Georgia's first-Tuesday sale schedule, and the multi-year gaps indicate Oconee holds tax sales rarely. Confirm any upcoming sale directly with the office.

Registration and deposit

Not published. The Tax Commissioner's Tax Sale page carries no bidder registration, deposit, ID, or payment terms. Call (706) 769-3917 or email [email protected] to confirm bidder requirements before a sale.

No online auction platform. No auction vendor is referenced anywhere on the Tax Commissioner's site, quick links, FAQ, or taxpayer brochure, and the county hosts no sale list of its own. Sales run through the statutory Georgia route: levy by the Tax Commissioner, advertisement in the county legal organ, and an in person cry sale, with the purchaser taking a redeemable deed subject to the 12-month right of redemption under O.C.G.A. 48-4-40 et seq. The office routes delinquent advertising to the statewide Georgia Public Notice database rather than posting a county list, so search that site by county to find the current advertisement. Excess funds from past sales are administered through Weissman law ([email protected]), and unclaimed balances are escheated to the state after five years.

Notes for Oconee County

  • The Tax Commissioner's designated Tax Sale page exists at https://www.oconeecountypay.com/tax-sales.html but its main content region contains only an empty HTML stub comment, so the county publishes no sale date, location, platform, or bidder terms.
  • No online auction platform is referenced anywhere on the Tax Commissioner's site. Treat Oconee as an in person courthouse sale under O.C.G.A. Title 48 and confirm the location with the office before bidding.
  • Delinquent listings are pointed to the statewide Georgia Public Notice database run by the Georgia Press Association, labeled "Oconee County Delinquent Property Tax Listings" in the office's Quick Links. The county hosts no sale list of its own.
  • The Excess Funds listing (created December 2024) shows tax sale dates of April 2, 2013, May 5, 2015, and June 6, 2017. All three are the first Tuesday of the month, and the gaps between them indicate Oconee conducts tax sales infrequently.
  • Excess funds claims are handled through Weissman law at [email protected]; unclaimed funds are escheated to the state as unclaimed property after five years.
  • Property taxes are normally due November 15 each year. Interest accrues monthly at the bank prime loan rate plus 3% (O.C.G.A. 48-2-70), plus a 5% penalty every 120 days after the due date up to 20% total.
  • Office hours are Monday through Friday, 8:00 AM to 4:30 PM. Physical office: 7635 Macon Highway, Watkinsville, GA 30677; mailing address adds Suite 300. Email [email protected].
  • The Board of Tax Assessors handles values at (706) 769-3921. The Clerk of Superior Court, which holds deed records, is at the Oconee County Courthouse, 23 North Main Street, Watkinsville, (706) 769-3940.
  • The county's legacy domain oconeecounty.com issues a 301 redirect to the current official site oconeecountyga.gov. The Tax Commissioner operates a separate Government Window site at oconeecountypay.com.

Georgia statewide rules

Redemption
The right to redeem runs for 12 months from the date of the sale and does not end there. It continues after the year until the tax deed purchaser forecloses it by serving and publishing the statutory barment notice, which cannot be started until 12 months have passed. The purchaser delivers the notice to the sheriff at least 45 days before the redemption deadline named in it, and publishes it once a week for four consecutive weeks in the six months immediately before that deadline. Redemption puts title back in the defendant in fi. fa. subject to the liens that existed at the sale, and the purchaser must execute and record a quitclaim deed. Title under a tax deed recorded on or after July 1, 1996 ripens by prescription four years after recording. Judicial in rem foreclosures under Article 5 run on a different clock: the owner has 60 days after the sale to redeem by paying the minimum bid price into the superior court.
Deed deposit
Georgia sets no statewide percentage deposit. A purchaser at a judicial sale may tender cash or a cashier's or certified check drawn for the purchase price and issued or certified by a federally insured financial institution. Counties publish their own payment terms, and many require payment in full at the close of the sale, so confirm the terms with the tax commissioner before bidding.
Surplus proceeds
Excess funds left after taxes, costs, and the expenses of the sale belong to the former owner and to recorded lienholders in order of priority. The officer who sold the property must mail notice of the excess funds by first-class mail within 30 days to the record owner at the time of the sale, to the holder of each security deed, and to every other party with a recorded equity interest or claim, and may file an interpleader action in superior court. Funds still unclaimed five years after the sale are paid over to the Georgia Department of Revenue, after which only a court order from an interpleader action releases them.
Governing statute
O.C.G.A. Title 48, Chapter 4

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
