Tax deed sale

RealAuction
Run by
Gregg County Sheriff's Office, conducting the sale online through Realauction.com, LLC. The auction site states: "The tax foreclosure sale is conducted by the Gregg County Sheriff's Office, facilitated by Realauction.com, LLC." The bidder's Written Statement is issued by the Gregg County Tax Assessor-Collector, and winning-bid payment is made to the Gregg County District Clerk.
Frequency
annual
Typical timing
First Tuesday of the month, online, when properties are set for sale. The county auction site's FAQ states: "The sales are conducted between 10:00 a.m. CT and 2:00 p.m, and will run one at a time in the order listed beginning at the start time. All sales will cease at 2:00 p.m. CT on the day of the sales and any sales not completed may be reposted for a future date." The site adds: "All times used on this website are Central time zone." Checked on 2026-07-26, the RealForeclose auction calendar showed no scheduled or active auction date in any month from January 2025 through December 2026, so Gregg County posts sales only when foreclosure judgments are ready. Separately, the county publishes a monthly first-Tuesday Foreclosure List on its News and Events page; the current entry is dated August 1, 2026 and links to a PDF titled august-4-2026-foreclosure-list.pdf.

Registration and deposit

Two separate steps, both required before the sale. 1) Bidder account and deposit. Register on the Gregg County RealForeclose site at least five business days before the auction; one account per bidder. A deposit equal to 5 percent of the bidder's intended maximum bid must be funded by ACH or wire and be settled and allocated to Gregg County before the auction starts. Wire deposits must be received by 5 p.m. Eastern two business days before the auction; ACH deposits must be initiated by 4 p.m. Eastern five business days before the auction. Cash deposits and international funds are not accepted. 2) Written Statement under Tax Code 34.015. The FAQ states bidders "must retrieve a Request for Written Statement from the Gregg County Tax Office at least one week prior to the auction," or download the preprinted Form 50-307 from the auction site's External Links. The form must be completed, notarized and sent to the County Tax Office, PO Box 1431, Longview, TX 75606, with the $10 fee; the form itself states "Fee must be paid by Cash, Cashires Check, or Money Order." Allow 3 to 5 business days for issuance. The certified Written Statement (bidder certificate) is valid 90 days and must be submitted to the County Sheriff's Office in person or by US mail before the day of the sale. The site warns: "Sheriff's deed will NOT be issued without a valid Written Statement on file." Bidding is by proxy: the system bids $100 over the next highest bidder up to your maximum. Any bid inside the last 30 seconds extends bidding by one minute, but all sales cease at 2:00 p.m. CT. The balance of a winning bid is due by 2:00 p.m. CT the day of the sale by wire transfer, cashier's check or money order payable to the Gregg County District Clerk.

Gregg County moved its tax foreclosure sales fully online. The auction site states the Sheriff is authorized to sell by online bidding "Pursuant to Texas Property Tax Code, section 34.01 (a-1) and 34.05 (d) and as further provided in the Resolution To Allow Online Auctions For Tax Foreclosure Sales, Tax Resales And to Adopt Rules Governing Online Auctions adopted by the vote of Commissioners Court of Gregg County, Texas, on August 24, 2021, and recorded as instrument number 2021-007029 in the Official Real Property Records of Gregg County, Texas." The FAQ confirms: "Tax sales are now conducted entirely online via this web site. It is no longer necessary to appear in person to participate in the sale." Texas sells a redeemable deed, not a lien certificate. The site states purchasers "will receive an ordinary type of sheriff's deed which is WITHOUT WARRANTY, express or implied. Title to property is NOT guaranteed," that all property is "subject to a statutory right of redemption by the prior owner," and that a buyer takes title subject to any post-judgment taxes. Allow 3 to 5 weeks for the deed. Delinquent tax collection and the sale process are handled by Linebarger Goggan Blair and Sampson, LLP; the site's welcome letter from District Clerk Trey Hattaway directs process questions to LGBS at (972) 932-8404 and technical questions to Realauction customer service at (877) 361-7325. Struck-off inventory is held for resale: the Tax Assessor-Collector page links a PDF list, Gregg County Property Up For Resale, whose footer reads "Linebarger Goggan Blair & Sampson, LLP, Attorneys At Law, represent the owners of the above properties. If you are interested in any of the properties on this list, please contact Kim Regalado at 903-758-6181 (Extn: 4219). The offices of Linebarger Goggan Blair & Sampson, LLP are located at 217 N. Center Street, Longview, Texas, 75601." That list carried 29 parcels with struck-off dates. The LGBS listing site taxsales.lgbs.com also carries 29 Gregg County records, all typed STRUCK OFF and flagged "Available for Future Sale," with no scheduled sale date. The Foreclosure List the county posts on its News and Events page is the county clerk's packet of first-Tuesday notices; the August 4, 2026 packet sampled at pages 1 to 10 and 55 to 67 contained nonjudicial deed-of-trust trustee sale notices, not tax foreclosures, so use the RealForeclose calendar for tax sale items.

Over-the-counter (leftover) purchases

Texas has no over-the-counter certificate list. Parcels that draw no sufficient bid are struck off to the taxing unit that requested the order of sale, and that unit may resell them at any time by public or private sale. A public resale requested through the sheriff or constable may be sold for any amount. A private sale generally may not go below the lesser of the market value stated in the judgment or the total judgments against the property, unless every taxing unit entitled to proceeds consents. Ask the county or its delinquent-tax law firm for the current struck-off inventory.

Notes for Gregg County

  • Sale conductor: Gregg County Sheriff's Office; auction hosted by Realauction.com, LLC on the RealForeclose platform at https://gregg.texas.sheriffsaleauctions.com (page title reads "RealForeclose- Gregg County"). The site returns 403 to plain scripted fetches and needs a normal browser user agent.
  • Winning-bid payee is the Gregg County District Clerk, not the Tax Assessor-Collector. The auction site's welcome letter is signed by Trey Hattaway, District Clerk.
  • Bidder Written Statement under Tax Code 34.015: preprinted Comptroller Form 50-307 for the Gregg County Tax Assessor-Collector, $10 fee, mail to County Tax Office, PO Box 1431, Longview, TX 75606, phone (903) 237-2552. Notarization required; valid 90 days; must be on file with the Sheriff before the sale or no deed issues.
  • Deposit is 5 percent of intended maximum bid, ACH or wire only, settled and allocated before the auction opens. Balance due by 2:00 p.m. CT on sale day by wire, cashier's check or money order.
  • As of 2026-07-26 the RealForeclose auction calendar listed no scheduled or active auction dates for any month in 2025 or 2026; Gregg posts sales only when judgments are ready, so treat the first-Tuesday cadence as the statutory window rather than a guaranteed monthly sale.
  • Delinquent-tax law firm: Linebarger Goggan Blair and Sampson, LLP, Longview office at 217 N. Center Street, Longview, TX 75601; sale-process line (972) 932-8404; struck-off inquiries to Kim Regalado at 903-758-6181 ext. 4219.
  • Realauction customer service for registration, deposits and bidding: (877) 361-7325, [email protected].
  • The county's monthly Foreclosure List on greggcounty.texas.gov News and Events is the county clerk's first-Tuesday notice packet and is dominated by deed-of-trust trustee sales; it is not the tax sale list.
  • Notice publication per the LGBS venue record for Gregg County: "The News Telegram." This was read from the LGBS site data, not from a county page, so verify before publishing it as the newspaper of record.
  • Gregg County struck-off inventory is searchable on taxsales.lgbs.com (29 records, all "Available for Future Sale"), but Gregg does not appear in that site's list of counties with a currently scheduled auction.

Texas statewide rules

Redemption
The redemption clock runs from the date the purchaser's deed is filed for record, not from the sale date. Property that was the owner's residence homestead or was land designated for agricultural use when the suit or the warrant application was filed, and any mineral interest, may be redeemed on or before the second anniversary of that filing. Every other property may be redeemed only through the 180th day after the deed is filed. When a parcel is struck off to a taxing unit instead, the period runs from the date the taxing unit's deed is filed for record. The former owner has no right to use, possess, or collect rent from the property while the redemption right runs, and the right of redemption cannot be sold or transferred: any instrument purporting to transfer it is void.
Deed deposit
The Tax Code sets no statewide deposit and no buyer premium. Section 34.01 directs the officer to conduct the sale the way similar property is sold under execution, so payment terms are set locally by the officer who runs the sale. Most Texas counties collect the full bid in cash or by cashier's check on the day of the sale. Confirm the terms with the county before you bid.
Homestead deeds
Texas sets no separate opening bid for a homestead. What changes on a homestead parcel is the exit: a residence homestead, land designated for agricultural use when the suit or warrant application was filed, and a mineral interest all carry a two-year redemption right instead of 180 days, and the premium the owner pays can reach 50 percent in the second year. Price a homestead parcel for that longer clock.
Surplus proceeds
The officer pays any excess proceeds to the clerk of the court that issued the order of sale. The clerk holds the excess for two years after the sale and notifies the former owner when the amount exceeds $25. A claim must be filed before the second anniversary of the sale. The court pays established claims in statutory priority: a purchaser at a sale later adjudged void, taxing units for post-judgment or omitted taxes, other lienholders, taxing units for unsatisfied judgment amounts, and then the former owner. Anything unclaimed is distributed to the taxing units.
Governing statute
Tex. Tax Code Chapter 34

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
