- Texas tax foreclosure sales run on the first Tuesday of the month under Tex. Tax Code § 34.01. Hopkins County sells online, and its auction site sets the window: "The sales are conducted between 1:30 p.m. CT and 4:00 p.m. CT. All sales will cease at 4:00 p.m. CT on the day of the sales and any sales not completed may be reposted for a future date." Linebarger's Hopkins County record gives the same day differently, as sales "conducted between 10:00 a.m. CT and 4:00 p.m. CT, beginning at 1:30 pm." Hopkins County posts a sale only when judgments are ready, and the RealForeclose auction calendar showed no scheduled auction dates for July, August, or September 2026 when checked on 2026-07-26.
Registration and deposit
Bidding is online through the county's RealForeclose site. The Tax Foreclosure Sale Process page states: "Anyone may bid on the properties by registering on this site at least five (5) business days before the auction. One account will be established for each bidder." The FAQ adds that "a deposit equal to 5% of the bidders intended total bid must be made prior to the auction. This deposit must be made via ACH or wire transfer," that ACH takes 5 business banking days to settle and wires up to 48 hours, and that deposits must be settled and allocated to Hopkins County before the auction starts. Winning bidders owe the balance by 4:30 p.m. CT on the sale date, paid "via wire transfer or in person to the Linebarger Law Firm Representative located in the Hopkins County Tax office, 128 Jefferson St, Sulphur Springs, Texas." Linebarger's Hopkins County record answers bidder registration only with "For more information, contact the officer conducting the sale," so confirm any Tex. Tax Code § 34.015 written statement of no delinquent taxes with the Constable's office before you bid.
Hopkins County sells online, not at the courthouse door. The county's own auction page states: "Pursuant to Texas Property Tax Code, section 34.01 (a-1) and 34.05 (d) and as further provided in the Resolution To Allow Online Auctions For Tax Foreclosure Sales, Tax Resales And to Adopt Rules Governing Online Auctions adopted by the vote of Commissioners Court of Hopkins County, Texas, on October 24,2022 and recorded as instrument number 2022-6874 in the Official Real Property Records of Hopkins County, Texas, the Constable of Hopkins County, Texas is authorized to conduct a public auction of tax foreclosure sale property using online bidding and sale." It adds: "The tax foreclosure sale is conducted by the Hopkins County Constable's office, facilitated by Realauction.com, LLC." The FAQ confirms "Tax sales are now conducted entirely online via this web site. It is no longer necessary to appear in person to participate in the sale." Delinquent tax collection and the property list are handled by Linebarger Goggan Blair & Sampson LLP, whose portal the Tax Assessor-Collector links as "Property Tax Sale Information." After payment the county issues a tax sale deed, and the county page says to "allow 3 to 5 weeks for issuance of the deed" and that "All property purchased at tax sale is subject to a statutory right of redemption." Bidders take title subject to the § 34.21 redemption period, 2 years for homestead, agricultural-use, and mineral interests, 180 days for other property.

Texas has no over-the-counter certificate list. Parcels that draw no sufficient bid are struck off to the taxing unit that requested the order of sale, and that unit may resell them at any time by public or private sale. A public resale requested through the sheriff or constable may be sold for any amount. A private sale generally may not go below the lesser of the market value stated in the judgment or the total judgments against the property, unless every taxing unit entitled to proceeds consents. - Linebarger's Hopkins County record still lists a physical sale location, "at the Southwest steps, 118 Church Street of the Courthouse of the said County, in the City of Sulphur Springs, Texas," while the county's own auction site states sales are now conducted entirely online. Read the published notice of sale for each specific sale.
- Notice of sale is published in the Sulphur Springs News Telegram, per Linebarger's Hopkins County record.
- Payment goes to the "Linebarger Law Firm" by wire transfer, or in person to the Linebarger representative located inside the Hopkins County Tax Office at 128 Jefferson St.
- Struck-off inventory exists. Linebarger's Hopkins County feed showed 2 struck-off parcels marked "Available for Future Sale" on 2026-07-26, both in Sulphur Springs (Carter Street and Oma Street). Texas statewide rules
- Redemption
- The redemption clock runs from the date the purchaser's deed is filed for record, not from the sale date. Property that was the owner's residence homestead or was land designated for agricultural use when the suit or the warrant application was filed, and any mineral interest, may be redeemed on or before the second anniversary of that filing. Every other property may be redeemed only through the 180th day after the deed is filed. When a parcel is struck off to a taxing unit instead, the period runs from the date the taxing unit's deed is filed for record. The former owner has no right to use, possess, or collect rent from the property while the redemption right runs, and the right of redemption cannot be sold or transferred: any instrument purporting to transfer it is void.
- Deed deposit
- The Tax Code sets no statewide deposit and no buyer premium. Section 34.01 directs the officer to conduct the sale the way similar property is sold under execution, so payment terms are set locally by the officer who runs the sale. Most Texas counties collect the full bid in cash or by cashier's check on the day of the sale. Confirm the terms with the county before you bid.
- Homestead deeds
- Texas sets no separate opening bid for a homestead. What changes on a homestead parcel is the exit: a residence homestead, land designated for agricultural use when the suit or warrant application was filed, and a mineral interest all carry a two-year redemption right instead of 180 days, and the premium the owner pays can reach 50 percent in the second year. Price a homestead parcel for that longer clock.
- Surplus proceeds
- The officer pays any excess proceeds to the clerk of the court that issued the order of sale. The clerk holds the excess for two years after the sale and notifies the former owner when the amount exceeds $25. A claim must be filed before the second anniversary of the sale. The court pays established claims in statutory priority: a purchaser at a sale later adjudged void, taxing units for post-judgment or omitted taxes, other lienholders, taxing units for unsatisfied judgment amounts, and then the former owner. Anything unclaimed is distributed to the taxing units.
