Tax deed sale

Run by
Reagan County Sheriff's Office
Frequency
annual
Typical timing
Texas tax foreclosure sales run on the first Tuesday of the month under Tax Code 34.01, and Reagan County publishes no tax sale calendar of its own. The County Clerk's page confirms the courthouse is the designated first-Tuesday sale site, stating: "The trustee sales are held on the first Tuesday of every month in the vestibule just inside the South doors of the Reagan County Courthouse." That sentence describes deed-of-trust trustee sales rather than tax foreclosures, so confirm the tax sale date, hour, and exact spot with the Sheriff or the Tax Assessor-Collector before traveling.

Registration and deposit

No county registration page or online bidder portal exists for Reagan County. Under Texas Tax Code 34.015, a purchaser at a tax sale in a county that has adopted the requirement must present a written statement from the county tax assessor-collector showing no delinquent property taxes are owed before the officer conducting the sale will deliver a deed. Request that statement from the Reagan County Tax Assessor-Collector at 325-884-2131, and ask the Sheriff's Office what it requires on sale day.

Reagan County sells redeemable tax deeds through the Sheriff at the courthouse in Big Lake. No online auction platform was verified for this county, and no county office posts a sale page, bidder packet, or delinquent property list on the web. The county website's office directory carries no tax sale entry, the public notices calendar showed no tax sale notice when checked, and the Sheriff's Office website posts only law enforcement and jail information. Two statewide delinquent tax firm listings came back empty as well: MVBA Law's upcoming Texas tax sales page did not include Reagan County, and a Reagan County query against the Linebarger tax sale property search returned zero listings, so the county's delinquent tax counsel is not identified online. Plan on newspaper and courthouse-door notice as the practical list, and call the offices below to confirm whether a sale is set. Redemption follows Texas Tax Code 34.21: two years at a 25 percent or 50 percent premium for homestead, agricultural-use, and mineral interests, and 180 days at 25 percent for other property.

Over-the-counter (leftover) purchases

Texas has no over-the-counter certificate list. Parcels that draw no sufficient bid are struck off to the taxing unit that requested the order of sale, and that unit may resell them at any time by public or private sale. A public resale requested through the sheriff or constable may be sold for any amount. A private sale generally may not go below the lesser of the market value stated in the judgment or the total judgments against the property, unless every taxing unit entitled to proceeds consents. Ask the county or its delinquent-tax law firm for the current struck-off inventory.

Notes for Reagan County

  • No Reagan County office publishes a tax sale page, sale calendar, bidder packet, or delinquent property list online. The county website office directory has no tax sale entry and the public notices calendar carried no tax sale notice when checked.
  • Sales run in person at the courthouse. The County Clerk's page states that first-Tuesday sales are held "in the vestibule just inside the South doors of the Reagan County Courthouse," though that page covers deed-of-trust trustee sales rather than tax foreclosures. Treat it as the courthouse's designated sale location and verify with the Sheriff.
  • No online auction platform was verified. MVBA Law's upcoming Texas tax sales list did not include Reagan County, and a Reagan County query on the Linebarger tax sale property search returned no listings. The county's delinquent tax law firm is not named on any official page found.
  • Reagan County Sheriff's Office: Sheriff Jeff Garner, 320 N. Plaza Ave., Big Lake, TX 76932, phone 325-884-2424. The office website posts no sale notices.
  • Tax Assessor-Collector Cynthia Aguilar, confirmed by the Texas Comptroller county directory: 300 N. Plaza Ave., mailing P.O. Box 100, Big Lake, TX 76932, phone 325-884-2131, fax 325-884-4104.
  • Reagan County Appraisal District handles valuation only: 409 E. 2nd Street, P.O. Box 8, Big Lake, TX 76932, phone 325-884-3275. Its site carries no delinquent tax or sale information.
  • Statutory notice for a Texas tax sale is published in a newspaper and posted at the courthouse door, so for a county this small the printed notice may be the only public list. Call the Tax Assessor-Collector or the Sheriff before planning a trip.

Texas statewide rules

Redemption
The redemption clock runs from the date the purchaser's deed is filed for record, not from the sale date. Property that was the owner's residence homestead or was land designated for agricultural use when the suit or the warrant application was filed, and any mineral interest, may be redeemed on or before the second anniversary of that filing. Every other property may be redeemed only through the 180th day after the deed is filed. When a parcel is struck off to a taxing unit instead, the period runs from the date the taxing unit's deed is filed for record. The former owner has no right to use, possess, or collect rent from the property while the redemption right runs, and the right of redemption cannot be sold or transferred: any instrument purporting to transfer it is void.
Deed deposit
The Tax Code sets no statewide deposit and no buyer premium. Section 34.01 directs the officer to conduct the sale the way similar property is sold under execution, so payment terms are set locally by the officer who runs the sale. Most Texas counties collect the full bid in cash or by cashier's check on the day of the sale. Confirm the terms with the county before you bid.
Homestead deeds
Texas sets no separate opening bid for a homestead. What changes on a homestead parcel is the exit: a residence homestead, land designated for agricultural use when the suit or warrant application was filed, and a mineral interest all carry a two-year redemption right instead of 180 days, and the premium the owner pays can reach 50 percent in the second year. Price a homestead parcel for that longer clock.
Surplus proceeds
The officer pays any excess proceeds to the clerk of the court that issued the order of sale. The clerk holds the excess for two years after the sale and notifies the former owner when the amount exceeds $25. A claim must be filed before the second anniversary of the sale. The court pays established claims in statutory priority: a purchaser at a sale later adjudged void, taxing units for post-judgment or omitted taxes, other lienholders, taxing units for unsatisfied judgment amounts, and then the former owner. Anything unclaimed is distributed to the taxing units.
Governing statute
Tex. Tax Code Chapter 34

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
