How Craig County sells delinquent taxes

No tax lien certificate sale

Virginia localities do not sell tax lien certificates to investors. The locality holds its own first-priority tax lien and enforces it through a judicial sale of the property.

Tax deed sale

Run by
Craig County Treasurer, with the auction conducted by a special commissioner appointed by the Craig Circuit Court
Frequency
annual
Typical timing
Craig County publishes no recurring tax sale month or standing auction calendar.
When it runs
Craig County publishes no recurring tax sale month or standing auction calendar. The county tax calendar is the anchor to work from: "Real Estate Taxes are payable in two installments. The due dates of these installments are June 5 and December 5," with bills mailed the last week in April and the first week in October. A parcel becomes eligible for judicial sale once it is delinquent on the 31 December following the second anniversary of a missed installment, and the auction itself is set case by case as the special commissioner's suit moves onto the circuit court docket.
Registration and deposit

There is no standing bidder registration list for Craig County, because there is no recurring county auction to register for. Terms of sale, deposit and bidder qualifications come from the published sale advertisement and the bid package issued for each special commissioner's sale. Call the Treasurer at 540-864-5641 or the Clerk of the Craig Circuit Court at 540-864-6141 to find out whether a delinquent tax suit is pending and what deposit the court has set before travelling to a sale.

Sale format and venue
Craig County holds no scheduled tax auction and posts no sale calendar or delinquent list on the county website. Delinquent real estate moves through Virginia's judicial route instead: the Treasurer certifies the delinquency, a court-appointed special commissioner files a suit in equity in the Craig Circuit Court, and the court confirms the sale. Sands Anderson PC names Craig County among the Virginia localities it has handled delinquent real estate tax collection for, and its Christiansburg office at 540-260-9011 is a useful call when asking whether a Craig County sale is in the pipeline. No online auction platform is confirmed for this county, so treat any sale as a live courthouse-style auction until the advertisement says otherwise, and expect the published legal notice to be the operative announcement. Third-party listing sites that carry courtesy notices for Virginia commissioner sales are not the seller and do not set the terms.

County notes

  • Craig County real estate tax bills are mailed the last week in April and the first week in October, with installments due June 5 and December 5. A missed installment draws a 10 percent late payment penalty, and repeated misses are what eventually put a parcel in front of a special commissioner.
  • The 2026 Craig County real estate tax rate is 56 cents per $100 of assessed value, useful for sizing the annual carry on a parcel before bidding.
  • Because there is no county auction page to watch, the circuit court file and the published legal advertisement are where a Craig County sale first surfaces. The Clerk of the Craig Circuit Court is Sharon P. Oliver, reachable at 540-864-6141 or by mail at P.O. Box 185, New Castle, VA 24127, with the office at 182 Main Street, Suite 4.
  • Ownership and assessment records sit with the Commissioner of the Revenue, Danielle Snider, at 540-864-6241, 182 Main Street, Suite 3, New Castle. That office is the first call for acreage, owner of record and tax relief status when running diligence on a parcel. The county also runs a public GIS viewer for parcel mapping.
  • Payoffs and current-year balances are handled by the Treasurer, who takes cards online through the county e-Services portal and by phone at 540-864-5641, with a 3 percent convenience fee on card transactions.

Virginia rules

Redemption
An owner listed in the published notice, or the owner's heirs, devisees, successors, and assigns, may redeem the real estate at any time before the date set for the judicial sale by paying into court everything due. The right ends when the sale happens; Virginia gives no redemption window after the hammer falls and no redemption window after the deed is recorded. Partial payment does not redeem the property and does not suspend, invalidate, or moot the suit. The treasurer may instead suspend the sale by entering an installment agreement with the owner running no more than 72 months, and an owner who defaults on such an agreement cannot enter a second one for the same property for three years. The same before-the-sale-only cutoff applies on the nonjudicial track under 58.1-3975. What does exist after the sale is not redemption but a challenge: a party served only by publication may petition for a rehearing for good cause within 90 days of the order confirming the sale.
Deed deposit
No statewide deposit percentage exists. Article 4 leaves the terms of sale to the special commissioner and the confirming court, so the deposit is whatever the advertised terms of that sale require. Read the terms of sale published with each auction and confirm accepted funds with the commissioner before bidding.
Surplus proceeds
The former owner and the owner's heirs, devisees, successors, or assigns are entitled to the surplus received from the sale above the taxes, penalties, interest, reasonable attorney fees, costs, and any liens chargeable on the parcel, and the burden is on the claimant to prove entitlement. If no claim is made within two years after the date the sale is confirmed, the clerk pays the money to the locality that received the sale proceeds. On the nonjudicial track, excess proceeds sit in an interest-bearing escrow account held by the treasurer, a claimant has two years from the date of sale to schedule a hearing in circuit court, and unclaimed money goes to the locality's general fund.
Governing statute
Va. Code Title 58.1, Chapter 39, Article 4

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
