How Galax City sells delinquent taxes

There is no fixed annual sale date. Galax advertises the parcels first, and the current notice reads: "On August 20, 2026, or as soon thereafter as may be effected, actions will be commenced under the authority of Virginia Code 58.1-3965, et seq., to begin proceedings to sell the following parcels of real estate for the payment of City of Galax, Virginia delinquent real estate taxes." The auction itself follows months later once the court enters a decree of sale. Recent Galax auctions closed June 8, 2026 at 11:00 AM ET, and were held April 15, 2025 at 11:30 AM and July 2, 2024 at 1:00 PM. Plan on roughly one sale a year and watch the TACS calendar for the decree date.
Registration and deposit

Registration and bidding are free and run entirely through the auctioneer site at tacssale.com. Every bidder must register and be approved by the auctioneer before bidding opens, and pre-bidding is available ahead of the closing time. To qualify you may not owe delinquent taxes to the City of Galax and may not be a defendant in a pending delinquent tax matter. Bidders without internet access can call TACS at 804-548-4408 or email [email protected] to have an account created and bids placed. The high bidder owes a deposit of 25 percent of the sale price or $1,000, whichever is higher, capped at $20,000 per parcel, plus a 10 percent buyer premium subject to a $150 minimum. Bids under $1,000 are paid in full at auction. The purchase contract is emailed after the close and must be signed and returned immediately, with the deposit and premium received within seven days by cashier check, money order or wire made payable to City of Galax. Cash and personal checks are refused. The balance and recording costs are due within 15 days of court confirmation.

Sale format and venue
Galax is an independent city, not part of Grayson or Carroll County, and collects its own delinquent real estate taxes through the City of Galax Finance Department. Accounts are then referred to Taxing Authority Consulting Services, PC, which files a suit in equity in circuit court and sells the property as court-appointed Special Commissioner under Va. Code 58.1-3965. The June 2026 sale ran online only on tacssale.com and was combined with Grayson County parcels in a single catalog, so confirm which jurisdiction a parcel sits in before bidding. Earlier Galax sales in 2024 and 2025 were simulcast live and online at the Crossroads Institute, 1117 East Stuart Drive, Galax, through For Sale At Auction, Inc., so read each individual notice for the format. Every sale is subject to confirmation by the circuit court, and the Special Commissioner may reject a bid judged unreasonable against the estimated value. Property conveys by special warranty deed, as-is and where-is, with no title search, title insurance or right-of-way guaranteed. Owners can stop the sale at any point before it by paying all accumulated taxes, penalties, interest, costs and fees.   • Galax is one of Virginia's 38 independent cities. It is surrounded by Carroll and Grayson counties but is a separate government with its own tax rolls, its own delinquent list and its own sale.
  • The Finance Department handles billing, collection and delinquent tax collection for real estate in the city, and the Municipal Building at 111 East Grayson Street is where accounts are paid.
  • The delinquent real estate tax list is published each summer in the city's public notices, most recently reflecting balances as of June 30, 2026, and covers taxes, storm water fees, penalty, interest and costs.
  • Once a parcel is referred for judicial sale, redemption payments go to Taxing Authority Consulting Services, PC at P.O. Box 31800, Henrico, VA 23294-1800, payable to City of Galax.

Virginia rules

Redemption
An owner listed in the published notice, or the owner's heirs, devisees, successors, and assigns, may redeem the real estate at any time before the date set for the judicial sale by paying into court everything due. The right ends when the sale happens; Virginia gives no redemption window after the hammer falls and no redemption window after the deed is recorded. Partial payment does not redeem the property and does not suspend, invalidate, or moot the suit. The treasurer may instead suspend the sale by entering an installment agreement with the owner running no more than 72 months, and an owner who defaults on such an agreement cannot enter a second one for the same property for three years. The same before-the-sale-only cutoff applies on the nonjudicial track under 58.1-3975. What does exist after the sale is not redemption but a challenge: a party served only by publication may petition for a rehearing for good cause within 90 days of the order confirming the sale.
Deed deposit
No statewide deposit percentage exists. Article 4 leaves the terms of sale to the special commissioner and the confirming court, so the deposit is whatever the advertised terms of that sale require. Read the terms of sale published with each auction and confirm accepted funds with the commissioner before bidding.
Surplus proceeds
The former owner and the owner's heirs, devisees, successors, or assigns are entitled to the surplus received from the sale above the taxes, penalties, interest, reasonable attorney fees, costs, and any liens chargeable on the parcel, and the burden is on the claimant to prove entitlement. If no claim is made within two years after the date the sale is confirmed, the clerk pays the money to the locality that received the sale proceeds. On the nonjudicial track, excess proceeds sit in an interest-bearing escrow account held by the treasurer, a claimant has two years from the date of sale to schedule a hearing in circuit court, and unclaimed money goes to the locality's general fund.
