How Henrico County sells delinquent taxes

No tax lien certificate sale

Virginia localities do not sell tax lien certificates to investors. The locality holds its own first-priority tax lien and enforces it through a judicial sale of the property.

When it runs
Online only, with bidding closing at 11:00 a.m. ET, run about twice a year in spring and fall. The current Henrico notice reads: "the following real property will be auctioned for sale to the highest bidder at an online only public auction, which will close on May 27, 2026 at 11:00am." Earlier Henrico rounds closed October 31, 2024, May 30, 2024 and October 23, 2023. Henrico is not on the TACS auction calendar right now, so join the TACS interested bidder list, which emails roughly three weeks before a scheduled sale.
Registration and deposit

Register free at tacssale.com and be approved by the auctioneer before bidding; registered bidders can enter a maximum bid and let the system bid in preset increments. You cannot bid if you owe delinquent taxes to the County of Henrico or are a defendant in a pending delinquent tax matter. On judicial parcels sold under Circuit Court decrees, the winner owes a deposit of 25 percent or $1,000, whichever is higher, capped at $20,000 per parcel, plus a 10 percent buyer's premium with a $150 minimum, all due within seven days of the auction close, with the balance and deed recording costs due within fifteen days of the court confirming the sale. On non-judicial parcels sold under Va. Code 58.1-3975, the full bid plus premium and recording costs are due within seven days. Pay by certified funds, cashier's check, money order or wire, made payable to County of Henrico and sent to TACS at P.O. Box 31800, Henrico, VA 23294-1800; cash and personal checks are refused. Bidders without internet access can call TACS at (804) 548-4408 for help creating an account and placing bids.

Sale format and venue
Henrico's delinquent real estate is auctioned online at tacssale.com rather than on the courthouse steps. Two tracks run side by side and often inside the same auction: a Special Commissioner's sale of parcels covered by Circuit Court decrees of sale, where every sale is subject to court confirmation, and a non-judicial sale under Va. Code 58.1-3975 of low value parcels that requires no suit and no confirmation. Property is conveyed by Special Warranty Deed and sold as is, where is and if is, subject to easements and rights of record, with no assistance obtaining title insurance and no guarantee the parcel has a right of way or is not landlocked; TACS advises an independent title search and a visual inspection before bidding. Bidding is legally binding and irrevocable, and a buyer who fails to settle forfeits funds toward $750 attorney fees, $250 auctioneer fees and any resale shortfall.     Read the Virginia due-diligence checklist before bidding. Redemption, liens that survive a tax deed, title cleanup, and payment deadlines can change what a parcel is worth.

  • Once Henrico refers a delinquent account, payment goes to the law firm rather than the county. The Department of Finance states: "Henrico County submits delinquent tax accounts to Taxing Authority Consulting Services, P. C. (TACS). Do not pay your delinquent taxes directly to Henrico County." The TACS collections line is 1-866-951-0742.
  • Henrico posts the auction notices on its own county website as well as on the TACS tax sale page, so the parcel table and terms for a scheduled sale can be read from either.
  • Inventory skews to small unimproved parcels, subdivision common areas and remnant lots rather than houses. The May 2026 offering was 16 non-judicial parcels, nearly all described as unimproved acreage or lots across the Fairfield, Brookland, Varina and Three Chopt districts.
  • A 10 percent buyer's premium with a $150 minimum is added to every winning bid. The Treasurer on non-judicial parcels, and the Special Commissioner on judicial parcels, can reject a bid judged unreasonable against the estimated value, and any unsold parcel is offered again at the next auction.
  • Owners redeem right up to the auction, and parcels marked REDEEMED drop off the advertised list before bidding closes, so confirm a parcel is still live before committing funds or ordering title work.
  • To bid you must be clear with the county: TACS requires that you not owe delinquent taxes to the County of Henrico and not be a defendant in any pending delinquent tax suit.

Virginia rules

Redemption
An owner listed in the published notice, or the owner's heirs, devisees, successors, and assigns, may redeem the real estate at any time before the date set for the judicial sale by paying into court everything due. The right ends when the sale happens; Virginia gives no redemption window after the hammer falls and no redemption window after the deed is recorded. Partial payment does not redeem the property and does not suspend, invalidate, or moot the suit. The treasurer may instead suspend the sale by entering an installment agreement with the owner running no more than 72 months, and an owner who defaults on such an agreement cannot enter a second one for the same property for three years. The same before-the-sale-only cutoff applies on the nonjudicial track under 58.1-3975. What does exist after the sale is not redemption but a challenge: a party served only by publication may petition for a rehearing for good cause within 90 days of the order confirming the sale.
Deed deposit
No statewide deposit percentage exists. Article 4 leaves the terms of sale to the special commissioner and the confirming court, so the deposit is whatever the advertised terms of that sale require. Read the terms of sale published with each auction and confirm accepted funds with the commissioner before bidding.
Surplus proceeds
The former owner and the owner's heirs, devisees, successors, or assigns are entitled to the surplus received from the sale above the taxes, penalties, interest, reasonable attorney fees, costs, and any liens chargeable on the parcel, and the burden is on the claimant to prove entitlement. If no claim is made within two years after the date the sale is confirmed, the clerk pays the money to the locality that received the sale proceeds. On the nonjudicial track, excess proceeds sit in an interest-bearing escrow account held by the treasurer, a claimant has two years from the date of sale to schedule a hearing in circuit court, and unclaimed money goes to the locality's general fund.
