How Fremont County sells delinquent taxes

No tax lien certificate sale

Idaho sells no tax lien certificate to investors. Under Idaho Code 63-1001 a delinquency has the force and effect of a sale to the county tax collector as grantee in trust for the county, so the county is the only party that ever holds the delinquency.

When it runs
Fremont County holds its tax deed auction once a year in late summer, at 9:00 a.m. in the Fremont County Courthouse foyer at 151 W. 1st N. in St. Anthony. The 2026 notice reads: "the Clerk of the Board of County Commissioners will sell at public auction at the courthouse door of the Fremont County Courthouse, St. Anthony, Idaho, at the hour of 9:00 a.m. on the 10th day of August 2026." The 2025 auction ran at 9:00 a.m. on August 18, 2025, and an earlier sale ran September 5, 2023. A 2027 auction list is already posted, but the county has not yet set the 2027 date or hour on it.
Registration and deposit

No advance registration is required. The county's auction list states: "You do not need to register with the county to bid at auction." Bidders come to the courthouse foyer and bid on each parcel over its published minimum. Cash and cashier's checks are the accepted forms of payment, and the sale notice states that payment is expected at the conclusion of the sale. All sales are final and binding, and the commissioners reserve the right to accept or reject any or all bids.

Sale format and venue
Fremont County's only public tax sale is the tax deed auction. Idaho sells no tax lien certificates, so there is no certificate, no interest rate and no bid-down bidding here. The county takes the deed for delinquent taxes first, then the Board of County Commissioners resells the parcel to the highest and best bidder for cash over a minimum bid set to cover back taxes, interest and costs. Bidding happens in person in the Fremont County Courthouse foyer in St. Anthony; the county uses no online auction platform and takes no online bids. Parcels sell subject to all easements, rights-of-way, covenants, restrictions, reservations, use regulations, accruing taxes of record, and applicable building and zoning ordinances. Improvements and appurtenances are included, personal property is not.

  • The county posts its tax deed auction list and a countywide unpaid tax listing on the Treasurer and Tax Collector page under Hearings/Auctions/Notices. The auction list carries the county's own caution that it "is for informational purposes only and may change before the time of the auction."
  • Sale notices run in the Standard Journal for two consecutive weeks before the auction. The 2026 notice was published July 24 and July 31 for an August 10 sale, and the 2025 notice August 1 and August 8 for an August 18 sale. A bidder watching for the next date should follow that paper as well as the county page.
  • Minimum bids are small. The four parcels offered on August 10, 2026 opened between $1,267.64 and $4,351.44, and one parcel at the 2025 sale opened at $395.43.
  • Three of the four parcels offered in August 2026 were subdivision lots at Island Park in the county's recreational north end, the fourth a townsite lot in Newdale. The five parcels on the pending 2027 list sit in St. Anthony, Ashton and Teton and are all 2022 tax-year delinquencies.

Idaho rules

Redemption
The window belongs to the county's holding period, not to the auction. After the tax deed issues to the county, the record owner or a party in interest may redeem by paying the delinquency with late charges, accrued interest and costs including title search and professional fees, plus the taxes that accrued after the deed. That right runs only up to the moment the commissioners enter into a contract of sale or the property is transferred by county deed. Fourteen months after issuance it expires regardless. Since 31-808 requires the auction within those same fourteen months, a buyer at the county auction takes the property with the redemption already extinguished, and the tax deed is presumptive evidence of the regularity of everything before it.
Deed deposit
No statutory deposit. The commissioners set a minimum bid covering all property taxes owing, interest and costs, and the parcel goes to the highest bidder over it. Payment terms are set by each county's own terms of sale, so confirm them before you bid.
