How Henry County sells delinquent taxes

The published notice states that "The county auditor and county treasurer will apply on or after 08/29/2025 for a court judgment against the tracts or real property" and that "The Auditor and Treasurer specifically reserve the right to withhold from the sale any parcel which has been listed in error." Payments to remove a parcel go to the Henry County Treasurer, and the Henry County Auditor's Office issues the tax deed after redemption expires.

The county's Notice of Real Property Tax Sale is headed "Henry County Indiana, Beginning 10:00 AM Local Time, September 18, 2025" and states "The public auction will begin on 09/18/2025 at 10:00 AM local time. The properties in the online auction will commence closing in batches at 03:00 PM local time on 09/18/2025 at www.zeusauction.com." The two prior notices show the same pattern: September 19, 2024 and September 21, 2023. The 2025 notice is the most recent one posted on the Treasurer's Office page, so confirm the next sale date there before planning around it.
Registration and deposit
Registration is completed on the auction site, not at the courthouse. The 2025 notice states "The period to register for the sale begins on August 19, 2025 at 11:00 AM local time and closes on September 17, 2025 at 3:00 PM local time. If you do not complete the full registration process for the sale you will not be approved to bid on the auction." Registration information and bidding procedures are posted at https://www.zeusauction.com. A bidder must first become a member of the auction web site and then, in the county's words, "must register for the Henry County auction, specifically." To bid you must also "complete IRS Form W-9 and agree to the registration statement described at IC 6-1.1-24-5.3(c) electronically, through the auction web site." Under IC 6-1.1-24-5.1 a business entity that seeks to register must provide a Certificate of Existence or Foreign Registration Statement under IC 5-23 from the Indiana Secretary of State to the Henry County Treasurer.
Henry County sells tax sale certificates at an annual online auction. The notice states the sale is "conducted as an electronic sale under IC 6-1.1-24-2(b)10, at the following web site: www.zeusauction.com," with parcels sold "at public auction to the highest bidder, subject to the right of redemption." Bidding goes up from a statutory minimum, and the county publishes the minimum for every parcel in the notice. The minimum covers delinquent taxes and special assessments, the current year taxes due and payable, all penalties, an auditor-prescribed amount that includes "one hundred seventy-five dollars ($175) for postage and publication costs" plus other direct tax sale costs, and any unpaid costs from a prior tax sale. The county warns that "Minimum bid amounts are prescribed by law and are subject to change prior to the auction date," and that it "may require successful bidders to pay said amounts (as applicable) as part of the purchase price, or otherwise, at the close of the online auction." Because property descriptions may be omitted for parcels that appear on the certified list in consecutive years, the notice directs bidders to the vendor for the full list: "A complete property list may be obtained at www.sriservices.com or in an alternative form upon request." A parcel comes off the sale if the judgment amount is paid first; for the 2025 sale the county required payment "by 12:00 PM local time on Wednesday, September 17, 2025" in cash or certified funds payable to the Henry County Treasurer at PO Box 1258, New Castle, IN 47362. Note that this sale moved online recently: the 2023 notice put the auction in the courthouse "2nd Floor Courtroom," while the 2024 and 2025 notices run it at zeusauction.com. Register on SRI / ZEUSFrom lien to deed
Indiana holds no general public tax deed auction. Once the redemption period runs out, the certificate holder files a verified petition in the same court that entered the judgment of sale, and the court directs the county auditor to issue the deed. That petition must be filed no later than three months after the redemption period expires, or the purchaser's lien terminates. One narrow exception exists: real property a county, city, or town executive has certified as vacant or abandoned is auctioned separately, and there the county auditor deeds fee simple title straight to the highest bidder with no right of redemption.
Over-the-counter (leftover) purchases
Parcels that draw no bid at the treasurer's tax sale pass to the county executive, which acquires a lien for the minimum sale price and receives a tax sale certificate. The county executive may then adopt a resolution and offer those certificates at a separate advertised public sale, often called the commissioners' certificate sale, priced below the minimum bid that failed at the tax sale. Notice runs once a week for three consecutive weeks with the final advertisement at least 30 days before the sale. - The standard period is one year after the date of the treasurer's tax sale. Several tracks run 120 days instead: a certificate bought at the county executive's certificate sale, a lien the county executive holds that was never sold on, a sale to a purchasing agency qualified under IC 36-7-17 or IC 36-7-17.1, a certificate the county executive assigns to another political subdivision, and a parcel that was not offered at the tax sale at all. Property on the county auditor's vacant and abandoned list carries no right of redemption after its sale. A county treasurer may also extend redemption by agreement with the owner, in which case the extended period ends one year after the date of that agreement.
- Surplus proceeds
- The treasurer applies the payment first to the taxes, assessments, penalties, and costs in the minimum bid, then to other delinquent property taxes, then deposits the remainder in a tax sale surplus fund. The owner of record at the time the parcel was certified for sale, or the purchaser on a redemption, may file a verified claim against that fund. Unclaimed surplus transfers to the county general fund three years after it was received.
