Tax deed sale
- Run by
- Trinity County Tax Assessor-Collector (Nancy Shanafelt) handles bidder registration and the written statement of no delinquent taxes; the foreclosure sale itself is conducted by the Trinity County Sheriff or a Constable. Trinity County's delinquent tax law firm is Perdue Brandon Fielder Collins & Mott, shown on the Tax Assessor-Collector page as "Perdue Brandon Collins Fielder & Mott (Deliquent Attorneys for Trinity County)".
- Frequency
- annual
- Typical timing
- No Trinity County sale notice is currently posted on the county's delinquent tax firm's sale page. That firm states the general Texas schedule: "Tax sales are conducted by the sheriff or a constable of the county where the property is located. The Texas Rules of Civil Procedure require sales be held on the first Tuesday of the month, between the hours of 10:00 a.m. and 4:00 p.m. at a place designated by the Commissioner's Court." The struck-off resale lists on the Trinity County Appraisal District site are dated June 2026 and take offers on a rolling basis rather than on a fixed sale date.
Registration and deposit
Per the county's delinquent tax firm: "The Commissioner's Court for the county in which the sale is being held may require that, to be an eligible bidder, a person must be registered as a bidder with the county tax assessor-collector before the sale begins." Every bidder must also obtain a written statement from the county tax assessor-collector showing no delinquent taxes are due, because "The officer conducting the sale cannot sign or deliver a deed to the successful bidder unless the bidder shows the officer a written statement from the county tax assessor-collector stating that the bidder has no delinquent taxes due." Sales are for cash, and most counties accept cash or cashier's checks. For struck-off resale property, offers go on the Trinity CAD Trust Property Resale Offer Form: "An offer may be made on any parcel shown on the Trust Property/Resale List... The taxing units in Trinity County reserve the right to accept or reject any or all offers. No title insurance or survey will be provided." The form states the bid approval process can take 3 to 6 months, approval notice is mailed within 4 to 6 weeks of approval, and the bidder then has 14 days to send the full amount by cashier's check or money order only.
Trinity County appears to run its tax foreclosure sale in person. No online auction platform is named on the county website, the Tax Assessor-Collector page, or the county's delinquent tax firm pages, so no platform URL is given here. The county website does have a "County Tax Sales" page, but its "Re-Sale Properties" and "Estray" sections are empty, so that page is an unfinished stub with no live listings. The live county-specific inventory is the struck-off resale program administered through the Trinity County Appraisal District: a Trinity CAD Resale Property List (excluding Westwood Shores) and a separate Westwood Shores Resale Property List, both dated June 2026, plus the Trust Property Resale Offer Form. Property reaches that list because, in the firm's words, "no bid being received at the original sheriff's auction" leaves it struck off to the taxing jurisdiction that requested the Order of Sale. Buyers at the sheriff or constable sale receive a deed "without warranty and subject to the owner's statutory right of redemption", with redemption running two years for homestead, agricultural-use property and mineral interests and 180 days for all other property, starting when the deed is filed with the county clerk. Call the Tax Assessor-Collector at 936-642-1637 to confirm the next sale date, location and registration cutoff before making plans.
Over-the-counter (leftover) purchases
Texas has no over-the-counter certificate list. Parcels that draw no sufficient bid are struck off to the taxing unit that requested the order of sale, and that unit may resell them at any time by public or private sale. A public resale requested through the sheriff or constable may be sold for any amount. A private sale generally may not go below the lesser of the market value stated in the judgment or the total judgments against the property, unless every taxing unit entitled to proceeds consents. Ask the county or its delinquent-tax law firm for the current struck-off inventory.

Texas statewide rules
- Redemption
- The redemption clock runs from the date the purchaser's deed is filed for record, not from the sale date. Property that was the owner's residence homestead or was land designated for agricultural use when the suit or the warrant application was filed, and any mineral interest, may be redeemed on or before the second anniversary of that filing. Every other property may be redeemed only through the 180th day after the deed is filed. When a parcel is struck off to a taxing unit instead, the period runs from the date the taxing unit's deed is filed for record. The former owner has no right to use, possess, or collect rent from the property while the redemption right runs, and the right of redemption cannot be sold or transferred: any instrument purporting to transfer it is void.
- Deed deposit
- The Tax Code sets no statewide deposit and no buyer premium. Section 34.01 directs the officer to conduct the sale the way similar property is sold under execution, so payment terms are set locally by the officer who runs the sale. Most Texas counties collect the full bid in cash or by cashier's check on the day of the sale. Confirm the terms with the county before you bid.
- Homestead deeds
- Texas sets no separate opening bid for a homestead. What changes on a homestead parcel is the exit: a residence homestead, land designated for agricultural use when the suit or warrant application was filed, and a mineral interest all carry a two-year redemption right instead of 180 days, and the premium the owner pays can reach 50 percent in the second year. Price a homestead parcel for that longer clock.
- Surplus proceeds
- The officer pays any excess proceeds to the clerk of the court that issued the order of sale. The clerk holds the excess for two years after the sale and notifies the former owner when the amount exceeds $25. A claim must be filed before the second anniversary of the sale. The court pays established claims in statutory priority: a purchaser at a sale later adjudged void, taxing units for post-judgment or omitted taxes, other lienholders, taxing units for unsatisfied judgment amounts, and then the former owner. Anything unclaimed is distributed to the taxing units.
A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
