How Bear Lake County sells delinquent taxes

Idaho sells no tax lien certificate to investors. Under Idaho Code 63-1001 a delinquency has the force and effect of a sale to the county tax collector as grantee in trust for the county, so the county is the only party that ever holds the delinquency.

When it runs
One tax deed sale a year, held at 1:00 p.m. before the Board of County Commissioners at a regular meeting in the Bear Lake County Courthouse, most recently in September or October. The 2025 notice reads: "A Tax Deed Sale shall be held on the below listed properties before the Board of County Commissioners on October 14, 2025, at the hour of 1:00 o'clock P.M, on the Bear Lake County Courthouse, 30 North Main, Paris, Idaho." The 2024 sale ran September 9 at 1:00 p.m. and the 2017 notice called it "THE BEAR LAKE COUNTY ANNUAL TAX SALE". The county has not posted a date for the next sale.
Registration and deposit

No advance registration, deposit or online account. Bidding happens in person at the courthouse, and the 2024 notice states "Must be present to bid." The Board sells to the highest bidder for cash and reserves the right to accept or reject any and all bids. Call the Treasurer at (208) 945-2155 ext. 7 before the sale to confirm which parcels are still on the list and what payment the county will take that day.

Sale format and venue
Bear Lake County sells no tax lien certificates. The Treasurer deeds delinquent parcels to the county once the redemption period runs, and the Board of County Commissioners then resells that land at public auction under Idaho Code 31-808. Bidding opens at the county's minimum, which covers the delinquent taxes, interest, late fees and costs printed for each parcel in the notice, and the highest bidder pays cash. The 2019 auction notice put it plainly: the Board will "offer for sale at public auction provided by Section 31-808, Idaho Code, and sell to the highest bidder for cash the following described properties owned by Bear Lake County and not necessary for its use." Recent sales have been small, running three parcels plus several mineral-rights-only interests in 2024 and mineral rights alone in 2025, so read the notice before travelling.   • Bear Lake County publishes no standing tax-deed property list online. The Treasurer issues a Notice of Tax Deed Sale ahead of each auction, and that notice is the list: it names every parcel with its starting bid. Between sales, call the Treasurer at (208) 945-2155 ext. 7 for the current parcels.
  • The sale is advertised in the county's legal notices before it is held. The 2019 auction notice carried the line "Publish August 28, 2019" for a September 9 sale, matching the ten calendar day advertising window in Idaho Code 31-808.
  • The auction is conducted before the Board of County Commissioners at the Bear Lake County Courthouse, 30 N Main, Paris. The commissioners meet the second and fourth Mondays of each month at 9 a.m., and the Clerk of the Board takes agenda items at (208) 945-2155 ext. 5.
  • Watch the Notice of Pending Issue of Tax Deed as well. It names the parcels the Treasurer is about to deed to the county under Idaho Code 63-1005, the redemption cutoff, and the commissioners hearing date, so it is the earliest look at what may reach a later auction.
  • Many parcels that reach this auction are mineral-rights-only interests or landlocked ground. Legal descriptions are held by the Treasurer's office in Paris, so get them before you bid.

Idaho rules

Redemption
The window belongs to the county's holding period, not to the auction. After the tax deed issues to the county, the record owner or a party in interest may redeem by paying the delinquency with late charges, accrued interest and costs including title search and professional fees, plus the taxes that accrued after the deed. That right runs only up to the moment the commissioners enter into a contract of sale or the property is transferred by county deed. Fourteen months after issuance it expires regardless. Since 31-808 requires the auction within those same fourteen months, a buyer at the county auction takes the property with the redemption already extinguished, and the tax deed is presumptive evidence of the regularity of everything before it.
Deed deposit
No statutory deposit. The commissioners set a minimum bid covering all property taxes owing, interest and costs, and the parcel goes to the highest bidder over it. Payment terms are set by each county's own terms of sale, so confirm them before you bid.
