County notes
- The Treasurer and Tax Collector runs the delinquency and tax deed process from 219 South First Avenue, Suite 102 in Hailey, 208-788-5530. The Board of County Commissioners, at 206 South 1st Avenue, Suite 300 in Hailey, 208-788-5543, holds the tax deed hearings and sets any auction.
- Unpaid Blaine County taxes carry a 2 percent late charge plus 12 percent annual interest, and a parcel becomes subject to the tax deed process after three years of delinquency.
- The Treasurer's published tax deed calendar sends a first courtesy letter in July after the third delinquent year, a second letter in September, the Notice of Pending Issue of Tax Deed in January, and then holds the tax deed hearing in May. The commissioners' recent hearings have landed in early July instead, so treat May through July as the window when parcels move into county ownership.
- No parcel can reach auction until the county holds the deed, and Blaine County often clears its whole tax deed docket without a sale because owners pay before the hearing. An investor watching this county should expect long gaps between auctions and sometimes a year with none.
- Ask the Treasurer for the minimum bid, which covers back taxes, interest and the county's costs of sale, and for the deposit and payment terms before showing up to bid.
Idaho rules
- Redemption
- The window belongs to the county's holding period, not to the auction. After the tax deed issues to the county, the record owner or a party in interest may redeem by paying the delinquency with late charges, accrued interest and costs including title search and professional fees, plus the taxes that accrued after the deed. That right runs only up to the moment the commissioners enter into a contract of sale or the property is transferred by county deed. Fourteen months after issuance it expires regardless. Since 31-808 requires the auction within those same fourteen months, a buyer at the county auction takes the property with the redemption already extinguished, and the tax deed is presumptive evidence of the regularity of everything before it.
A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
