How Benewah County sells delinquent taxes

No tax lien certificate sale

Idaho sells no tax lien certificate to investors. Under Idaho Code 63-1001 a delinquency has the force and effect of a sale to the county tax collector as grantee in trust for the county, so the county is the only party that ever holds the delinquency.

When it runs
Benewah County works an annual cycle rather than a fixed calendar date. The Treasurer brings unredeemed delinquent parcels to a tax deed hearing before the Board of County Commissioners in May, the county takes its deeds, and the parcels go to sale in summer. The April 27, 2026 commissioners agenda records that "Tax Deed Hearing is set for 5/11 @ 10:00 a.m.", the March 9, 2026 minutes note that "An update was provided on upcoming tax deed sales hoping to be scheduled for July 13th, with two parcels identified for sale", and the Board approved those two tax deed sales at its July 13, 2026 meeting. The county publishes no standing date for the next sale, so track the Treasurer items on the commissioners agendas and call the Treasurer at (208) 245-2421 in spring.
Registration and deposit

Benewah County keeps an auction storefront on Public Surplus branded Benewah County Tax Sale, with a Real Estate category for tax sale parcels. Bidding there takes a free buyer account, created from the Register link on the storefront. The county publishes no separate bidder packet, deposit schedule or terms of sale document, so call the Treasurer at (208) 245-2421 for the minimum bid and payment terms on a specific parcel before you bid. The Board of County Commissioners approves each tax deed sale in open session, and the buyer pays the delinquent taxes owed on the parcel.

Sale format and venue
Benewah County publishes no tax-deed property list online. Parcels are advertised in the legal notices of the St. Maries Gazette Record and are named in the Treasurer items on the Board of County Commissioners agendas and minutes at benewahcountyid.gov. The county's published Notice of Tax Deed Property Auction says the Commissioners act "by virtue of the power given them by the provisions of Section 31-808 Idaho Code" and "will offer for sale at public auction to the highest bidder for cash" at the north courthouse door of the Benewah County Courthouse in St. Maries, with a minimum bid on each parcel covering the delinquent taxes, interest and penalties plus the county's legal advertising and deed recording costs. Title passes by quit claim deed, subject to public rights of way and easements of record, and the buyer pays the current year taxes. Two parcels sold on July 13, 2026, at $20,100 and $60,100, and the June 22, 2026 minutes record nine further county parcels "that have never been offered at public auction" under review for sale.

Benewah County tax sale list and auction calendar

For Benewah County tax sale 2026 searches, use the county-run sources below rather than a copied parcel list, and confirm the parcel, registration cutoff, deposit, and payment deadline against the county before you bid. If the parcels on this list are vacant land rather than houses, what buying land at a tax sale hands you is the place to start.

  1. Get the advertised list

Benewah County publishes no tax sale list online. The Benewah County Board of County Commissioners advertises the parcels ahead of the sale rather than posting them, so the list reaches bidders through the county legal newspaper and the office itself. Call (208) 245-2421 to ask for the current advertisement.
  2. Register to bid

Ask the county office how and when to register; many counties close registration days or weeks before the sale.
  3. Sale day

Benewah County works an annual cycle rather than a fixed calendar date. Bidding runs on County site; check posted sale dates, registration status, and bidding windows there.
  4. Confirm with the office

If the list, platform, and notice disagree, use Benewah County Board of County Commissioners as the source to confirm which parcels are actually offered.

Before you bid in Benewah County

  1. Start with the live sale list

There is no online list to price against. Benewah County advertises the parcels before the sale rather than posting them, so get the advertisement from the office on (208) 245-2421 and price from the parcel numbers it carries.
  2. Confirm registration and deposit

  3. Check the state rules that change the bid

Read the Idaho due-diligence checklist before bidding. Redemption, liens that survive a tax deed, title cleanup, and payment deadlines can change what a parcel is worth. Which liens survive is state law, so read what survives a tax deed in Idaho before you price the title work.
  4. Set a walk-away number

Work out what the parcel is actually worth with the rural land value estimator, then turn it into a ceiling with the tax deed max-bid calculator.

County notes

  • Idaho counties take the deed themselves before anything reaches the public. Benewah County holds a tax deed hearing each May, takes deeds on the parcels that are not redeemed or granted an extension, then resells the land it now owns. There is no lien certificate, no interest rate and no bid-down bidding here.
  • The redemption window closes before the auction. Under Idaho Code 63-1007 the former owner's right to redeem ends once the commissioners enter into a contract of sale, so a Benewah County buyer takes the parcel with redemption already extinguished.
  • Benewah County is small and its tax deed volume is small with it. The Treasurer reported that the May 11, 2026 hearing narrowed eleven or twelve properties down to two, and the Board approved two tax deed sales on July 13, 2026, at $20,100 and $60,100. Expect a handful of parcels in a normal year rather than a large catalog.
  • Two offices, two jobs. The Treasurer at (208) 245-2421, 701 W College Ave Suite 103, handles delinquency, the tax deed hearing and the parcel detail. The Board of County Commissioners at (208) 245-2234, 701 W College Ave Suite 106, orders the sale and approves each purchase in open session at the courthouse in St. Maries.
  • Parcels that draw no bid stay in county ownership and can come back later. The June 22, 2026 minutes record an accepted offer on the Andersen Heights parcels after they had been offered at public auction several times without selling, so ask the Treasurer which county-owned parcels are still available between sales.

Idaho rules

Redemption
The window belongs to the county's holding period, not to the auction. After the tax deed issues to the county, the record owner or a party in interest may redeem by paying the delinquency with late charges, accrued interest and costs including title search and professional fees, plus the taxes that accrued after the deed. That right runs only up to the moment the commissioners enter into a contract of sale or the property is transferred by county deed. Fourteen months after issuance it expires regardless. Since 31-808 requires the auction within those same fourteen months, a buyer at the county auction takes the property with the redemption already extinguished, and the tax deed is presumptive evidence of the regularity of everything before it.
Deed deposit
No statutory deposit. The commissioners set a minimum bid covering all property taxes owing, interest and costs, and the parcel goes to the highest bidder over it. Payment terms are set by each county's own terms of sale, so confirm them before you bid.
Governing statute
Idaho Code title 63, chapter 10

A tax deed does not convey marketable title. Most buyers file a quiet title action before they can resell or insure the property. See the due diligence guide.
